Disabled Rights

This is the second item’s accordion body. It is hidden by default, until the collapse plugin adds the appropriate classes that we use to style each element. These classes control the overall appearance, as well as the showing and hiding via CSS transitions. You can modify any of this with custom CSS or overriding our default variables. It’s also worth noting that just about any HTML can go within the .accordion-body, though the transition does limit overflow.

Determine disability:

To determine disability, consideration is given to whether the applicant suffers from one of the following conditions that hinder his integration into society or prevent him from living, earning a living, and achieving a dignified life after exhausting all treatment options or after it is certain that there is no future medical solution to these problems.

One of the following conditions:

  • Musculoskeletal disorders.
  • Respiratory disorders.
  • Circulatory disorders.
  • Digestive disorders.
  • Urinary and reproductive disorders.
  • Blood disorders.
  • Neurological disorders.
  • Mental disorders.
  • Immune system disorders.

If the applicant suffers from one or more of the above conditions, the Authority will refer them to a specialized medical committee to determine whether their condition falls under the definition of disability and determine the severity according to the following:

  • The applicant's current daily activities will be considered.
  • The disability will be medically consistent with the previous list.
  • The applicant's ability to perform their previous job related to the disability and the extent to which this disability is related to the disability.
  • The applicant's ability to perform other jobs based on their age.
  • The applicant's ability to learn and experience the skills necessary to face the future and integrate into society.

 

Medical report:

A comprehensive medical report and the required tests, including intelligence tests, hearing or vision tests, or other tests and examinations, are just one of the assessment tools used.

The medical report must include medical evidence supporting the existence of the disability.

The applicant for disability must provide all requirements in accordance with the Authority's regulations.

The medical report must be issued by the treating physician at a government hospital.

The report must be recent and no more than six months old from the date of the application.

Patient's Medical History :

  • Clinical Findings (All Documented Tests), such as Physical and Mental Health Examinations.
  • Laboratory Results (X-rays and Blood Tests)
  • Diagnosis
  • Prescribed Treatment and Response.
  • Final Diagnosis after Exhausting All Treatment Options.
  • The medical report must include a complete clinical examination, detailing what the applicant can do despite their previous disability.
  • Activities they can perform:
  • such as standing, sitting, walking, lifting and carrying objects to the correct place, handling hot and cold objects, putting things in the right place, avoiding hazards, hearing, speaking, moving around, and the way they come and go.
  • In cases involving mental and psychological disabilities, the report must include the psychiatrist's opinion on the applicant's ability to understand and carry out orders, remember instructions, and respond appropriately to caregivers, supervisors, and classmates and colleagues. The report must also include a description of the stressors in the work environment and the children's academic level in public and private education. It must also include self-care, motor performance in various activities, psychological and social assessments, task completion, and response to stimuli. If the child is a newborn or young infant, the report must include their responsiveness to stimuli.
  • All these symptoms are supported by additional laboratory and scientific tests that may be requested from other entities, physicians, or specialists other than the treating physician.
  • Evidence related to symptoms:
  • The effects of impairments are considered by the competent medical committee based on environmental factors, the applicant's age, and other factors.

Medical Committee:

The specialized medical subcommittee evaluates the medical or psychological condition of the applicant for disability and assesses the extent of their disability to determine whether a disability exists and its severity.

The committee consists of specialized physicians, each in their field of expertise, including ophthalmologists, orthopedists, psychologists, pediatricians, speech and hearing specialists, and all other specialties. Each in their field of expertise studies the applicant's medical file, examines the progression of the disease and its impact on their overall life, based on previous and new reports and examinations, listening to their symptoms, and examining them. This is to obtain a comprehensive and accurate picture of the progression of the disease and whether it rises to the level of disability.

After presenting it to the relevant committee, several possibilities emerge:

  • The committee determines that the impairment amounts to a disability. A disability certificate is issued, and the applicant is registered in the Authority's records as a disabled person. A certificate is issued to this effect, and the applicant can then enjoy the benefits granted to him by law.
  • The committee determines that the impairment does not amount to a disability at the time of submitting the disability application.
  • The committee may refer the applicant to another committee.
  • The committee may also request a waiting period depending on the case.
  • The committee may request a detailed report or additional specific tests and examinations.
  • If the disability result and severity are not approved, the applicant may resort to a neutral committee composed of doctors from Kuwait University to determine whether the disability or its severity should be modified. The application must be presented to the Grievances Committee within two months of the date of the meeting of the competent medical committee.
